The Pennsylvania Department of Labor & Industry’s Workers’ Compensation Office of Adjudication is soliciting applications for Workers’ Compensation Judge.

• Workers’ Compensation Judge • Location: Multiple Locations State Wide • Salary: $77,516-$110,377 annually • Application Deadline is June 1, 2013

Here is the description of duties and minimum qualifications from the test announcement: 

NATURE OF WORK   This is quasi-judicial work in the adjudication of Workers’ Compensation and Occupational Disease cases.  You will conduct mediations and quasi-judicial hearings and render decisions in accordance with Pennsylvania laws governing Workers’ Compensation and Occupational Diseases.  Work is performed within the broad framework of laws, regulations, and policies and is subject to general review by administrative supervisors through conferences and an evaluation of written decisions, conduct of proceedings and reports.   JOB REQUIREMENTS   You must be willing to travel.  Travel expenses will be paid. You are subject to Pennsylvania residency requirements and must be able to perform the essential functions of the job.   Conditions of Employment Workers’ Compensation Judges must abide by the Governor’s Code of Conduct and the Workers’ Compensation Act, including but not limited to those that prohibit the practice of law, and the conditions established for Workers’ Compensation Judges through Act 57 of 1996.   Necessary Special Requirement You must be an attorney in good standing before the Supreme Court of Pennsylvania. You must list your Pennsylvania Attorney I.D. number and expiration date on your Application.   Minimum Requirements Five years of Workers’ Compensation practice before administrative agencies, or equivalent experience.   Clarification of Requirements Only experience gained after graduation from an approved school of law will be considered qualifying.   Equivalent experience is defined as experience practicing before administrative agencies or courts of record on cases that involved the relationship between a person’s physical or psychological impairment and his or her ability to work.  This experience must have been in the capacity of one or a combination of the following:   •     Presiding over judicial or quasi-judicial proceedings as a judge, magistrate, or hearing officer •     Acting as a legal representative in judicial or quasi-judicial proceedings (Experience assisting attorneys in actual hearings is considered acceptable) •     Experience as a law clerk or opinion writer   If you did not work full-time in an acceptable area of the law, but have, over several years, handled cases that were related (e.g., social security disability, personal injury workers’ compensation, etc.), your experience will be pro-rated to determine if you have the equivalent of 5 years of full-time experience.  You must indicate on your application the number of hours you worked per week and the percentage of time you spent working in a related area of law.  If you do not include this information on your application you may be deemed ineligible.

Completing the Application

When you want to make application go to the home page at www.scsc.state.pa.us and on the left side you will see Online Services. Click on first time user to set up your user ID and password. Once you are registered you can view open jobs and apply via the drop down box. It will bring up the various test announcements. Under Administration, Accounting and Fiscal Control, you will click on the Workers’ Compensation Judge Test announcement and that will lead you to the online application. Please save the document as you continue to complete it.  When drafting your application, whether online or manually, for a given position, it is advisable that you clearly stipulate in writing on your application that you meet all of the required job specification standards even if that means your application is several pages in length. Otherwise, failure to incorporate these minimum standards can result in an applicant being found unqualified for a given position by the reviewer.

TESTING   The written work simulation test will be administered on a computer.  Information about computerized testing is available online at www.scsc.state.pa.us OR in paper form at any State Civil Service Commission office.   After your eligibility is determined, you will receive notification to schedule yourself for testing.  You will then be able to schedule your test date and time on the State Civil Service Commission’s website at www.scsc.state.pa.us. You will have a maximum of 4 hours to complete the test.  You will be required to analyze and appraise information; to apply law and regulations; to recognize and consider problems and implications; and to prepare clear, concise and well-organized written responses to case law questions.  The factors you will be rated on are Problem Solving Ability, Analytical Ability, and Written Communicative Ability. It will be to your advantage to become familiar with Articles I, II, III, IV and XIV of the Pennsylvania Workers’ Compensation Act of 1915 (as amended) and 34 Pa. Code, Chapters 123 and 131. Employment and promotion lists will be established.  You must take the test no later than July 27, 2013. You will be notified in writing of your test results
